Nanotechnology Law and Legal Engineering

Tuesday, March 7, 2006

Legal engineering is the process of creating a new societal order based on law. Through this method, the societal landscape and institutional architecture is designed, prior to the birth of the new society.

Normally, the legal system copes with tech development. The Guttenberg's printing machine creates Copyright Law, the invention of baloon and planes creates the air law and the first sputnik flight creates the space law. But, these happens at societies where the changes are not predictable. In the other hand, the road towards Molecular Nanotechnology (MNT) is very clear.

The inevitable path towards MNT makes legal engineering possible. The outcome of this process is anticipatory regulation. Any law resulted from this process can contain a defferred clause which will become alive and binding only after MNT capability is invented.
